This Privacy Policy ("Policy") details how Argil, Inc. ("Argil", "our", or "we") — a Delaware corporation with its registered office at Corporation Trust Center, 1209 Orange Street, Wilmington, New Castle County, Delaware 19801, United States (registered agent: The Corporation Trust Company) — collects, uses, and discloses certain Personal Information obtained through our website at argil.ai, as well as the information we process when providing our services via our software platform (referred to as the "Services").

By using our Services, you consent to the terms of this Policy. While providing our Services, we may gather user information on behalf of our clients. The collection and use of this data is directed by our contract with the relevant client and their specific privacy protocols.

We do not exert control over, nor can we be accountable for, the privacy practices of our clients or any third parties. The way OpenAI GPT-4 foundation model uses your data when using the model in our services is not our responsibility.

This Policy elucidates the kind of data we collect when you interact with the Site and/or the Services, the reasons for gathering such data, how it is utilized, and the rights and choices you possess.

1. Information we Collect and Maintain About You

1.1 Collection of information

When you register to Argil we will ask you for your name, email, and activity. These data are collected with your consent. When you take a paying account on Argil, we collect payment information via a third-party provider (Stripe). We are not responsible for issues arising solely under Stripe's responsibility. See Stripe's legal terms.

We also gather Usage data (interactions with our services: generations, models used, workflows, trainings). Purpose: provide the service, communicate with you, and improve the product. We may use Usage data for marketing unless you opt out. Argil does not collect information from third parties used to propose our services.

1.2 Categories of data

Personal Data. Collected only in agreement with the purpose you registered for, under legitimate interests. Retained while you are an active customer; you may request deletion at any time.

Web log data. IP address, domain name, pages visited, timing, approximate location, and cookie-related data, collected to deliver the Services. Legal basis: consent / acceptance of this Policy.

Cookies. Session and persistent cookies to improve experience, identify users, and collect usage data. Legal basis: legitimate interests.

Web beacons. May be used in emails to understand open rates and improve communication.

1.3 Face Data and Biometric Information (GDPR Article 9)

Certain Argil features (for example AI avatars, likeness replication, or identity / anti-impersonation checks) involve processing of photographs, videos, and facial characteristics. Where this processing qualifies as biometric data or other special categories of personal data under Article 9 GDPR (or equivalent laws), Argil processes it only under a valid legal basis, primarily your explicit consent under Article 9(2)(a) GDPR.

1.3.1 What Face Data We Collect

Depending on the feature you use, we may process:

Photographs and still images you upload that contain a face
Video recordings you provide (including speaking-to-camera captures)
Facial features / embeddings derived from those materials for avatar generation or likeness matching
Where enabled, a dedicated consent and/or liveness verification video (live or recorded) used to confirm that you are the person authorizing use of the likeness

This is not used to identify you against a general population database for unrelated surveillance. It is processed for the avatar / generation services you request.

1.3.2 Explicit consent (separate from general Terms)

Acceptance of the Terms of Service alone is not treated as consent to biometric processing under Article 9.

Where Article 9 applies, we rely on explicit, specific, informed and freely given consent, collected in connection with the avatar / face feature itself (not by general site browsing), which may include one or more of:

Informed notice in the Privacy Policy and related product copy describing the purpose (e.g. create a personalized avatar; verify liveness / identity for account safety)
Your affirmative action to upload or capture photo/video for that purpose
Where the flow provides it, a consent checkbox and/or liveness verification recording confirming you understand and agree to that processing
Ability to refuse avatar/biometric features and still use other parts of the Service that do not require face data

Consent is purpose-bound: face data collected for a User Avatar is not reused for unrelated marketing models or sold as a biometric dataset.

1.3.3 How We Use Face Data

Exclusively to:

Generate personalized AI avatars and likeness-based video / image outputs you request
Train or adapt your personalized model components needed for those outputs
Perform identity / liveness / anti-fraud checks when those controls are enabled
Improve the quality and safety of your generation pipeline

Face data is processed on infrastructure operated by Argil and its subprocessors (including cloud hosting such as Amazon Web Services (AWS) and Google Cloud Platform (GCP)), under contractual data-processing terms.

1.3.4 Storage and Security

Stored with industry-standard encryption in transit and at rest, access controls, secure transmission, and security reviews appropriate to the sensitivity of the data.

1.3.5 Sharing and Disclosure

We do not sell or rent face data. We do not use your face data to train general-purpose public foundation models for third parties. We may disclose data only: (i) to subprocessors strictly necessary to run the Service (hosting, GPU inference, storage); (ii) when required by law; (iii) to protect rights, safety, or property as allowed by law; or (iv) with your further explicit consent.

1.3.6 Retention and deletion

Retained while your account remains active and you use avatar / face-related features, unless a shorter period is required. Deletion requests to support@argil.ai are processed within 30 days. Account deletion triggers deletion of associated face data within 30 days, subject to legal retention obligations.

1.3.7 Withdrawal of consent and your rights

You may withdraw consent at any time without affecting the lawfulness of processing before withdrawal, by:

Stopping use of avatar / face features
Requesting deletion of face data via support@argil.ai
Closing your account

Withdrawal may prevent creation or regeneration of avatars that depend on that data. You also retain GDPR rights of access, rectification, erasure, restriction, and portability where applicable.

1.3.8 Third-party likenesses

If you upload or use images/videos of someone else, you represent that you have obtained all required rights and explicit consents from that person (and that you will indemnify Argil as set out in the Terms). Argil may require additional verification for licensed or marketplace avatars.

2. Framework to process user information

We process data to provide, maintain, and improve the service: account management, product optimization, contract performance (billing), news/promotions (opt-out available), and analytics under legitimate interests or consent where required.

Special category / biometric data is processed as described in section 1.3 under Article 9(2)(a) GDPR (explicit consent), not under a general “browse the site” or “accept Terms” catch-all.

3. With whom and why we share Personal Information

3.1 Service providers

Analytics, emailing, inference, and hosting providers acting on our behalf, including Amazon Web Services (AWS) and Google Cloud Platform (GCP), under data-processing agreements.

3.2 Analytics

Including Google Analytics. You may opt out of Google Analytics cookies.

3.3 Law enforcement

As described in our Terms, inappropriate use may lead to contact with law enforcement. We comply with lawful requests.

3.4 Business transfers

In a merger, acquisition, or sale, data may be shared for due diligence under appropriate safeguards.

3.5 Other parties

To protect rights and property of the Company; prevent or investigate wrongdoing; protect personal safety of users or the public; protect against legal liability.

4. External links

Third-party sites linked from Argil (including the blog) have their own policies. Argil is not responsible for those sites.

Some features use third-party model providers (e.g. OpenAI, Stability AI). Their data use is governed by their policies. Argil is an intermediary and is not responsible for model hallucinations or misuse of outputs.

5. Your Privacy Rights

Contact support@argil.ai to access, update, correct, or delete your information, or withdraw consent. Under GDPR you have rights to know what data we hold, correct it, delete it, unsubscribe from marketing, and withdraw consent. We respond within applicable legal timeframes.

6. Data retention

We retain personal information only as long as needed for the original purpose or as required by law. Usage Data may be kept for security and product improvement for shorter periods unless a longer retention is legally required. Data is discarded with techniques that prevent recovery.

7. Child's privacy

Our Service is not designed for individuals under 13. We do not purposefully collect personal data from anyone below this age. Contact us if you believe a child provided data; we will delete it promptly.

8. Changes to this Privacy Policy

We may update this Policy and will post the revised version on this page, with email and/or in-product notice when appropriate. The "Last updated" date will be refreshed. Changes take effect when published.
